These Terms of Use (hereinafter the "Terms") govern access to and use of the agde.city website (hereinafter the "Site"), published by Philippe Debref, sole trader (micro-enterprise), whose details appear in the Legal Notice.

Accessing and using the Site implies full and unreserved acceptance of these Terms by any user (hereinafter the "User").

1. Purpose of the Site

agde.city is a multilingual tourist and local information portal covering Agde, Cap d'Agde, Grau d'Agde, La Tamarissière and the Naturist Village. It provides Users with information on events, heritage, beaches, businesses, services and local news, as well as practical tools (weather, calendar, maps, etc.).

The Site also offers a professional area allowing local stakeholders to list their activity and publish advertisements, under the conditions set out in Article 6.

2. Access to the Site

The Site is freely accessible to any User with Internet access. Access and equipment costs (hardware, connection) remain the User's responsibility.

The publisher strives to keep the Site available 24/7 but cannot guarantee this. Access may be suspended, in particular for maintenance, updates, or in cases of force majeure, without the publisher's liability being engaged.

3. Free service

As of the publication date of these Terms, all Site services are provided free of charge to Users. The publisher reserves the right to offer paid services in the future, which would then be subject to separate terms of sale and prior express acceptance.

4. Site content

4.1 Nature of the information

Information published on the Site (opening hours, prices, events, contact details, descriptions) is provided for guidance only. Despite the care taken in its collection and updating, the publisher does not guarantee its completeness or permanent accuracy. Users are invited to verify sensitive information directly with the establishments or organisers concerned.

4.2 Intellectual property

The Site's content is protected by intellectual property law, in accordance with Article 3 of the Legal Notice. Any unauthorised reproduction is prohibited.

5. User obligations

The User undertakes to use the Site in accordance with these Terms, applicable laws and regulations, and public order. In particular, the User shall not:

fraudulently access or remain on the Site or disrupt its operation;
automatically and massively collect or extract Site data (scraping, harvesting) without written authorisation;
infringe the rights of third parties, or the image or reputation of the publisher, partners or other Users;
distribute unlawful, defamatory, abusive, discriminatory content or content contrary to public order.

Any breach may result in the suspension or removal of access to the Site, without prejudice to any legal action.

6. Professional area and contributions

6.1 Professional registration

Professionals may create a listing and publish advertisements (including rental advertisements) via the dedicated area. The professional warrants the accuracy of the information provided and holds the necessary rights to the content published (texts, photographs, logos).

6.2 Liability for published content

The professional is solely responsible for the content they publish and indemnifies the publisher against any third-party claims related to such content. The publisher acts as a host of this content within the meaning of Article 6 of the LCEN and does not exercise systematic prior editorial control.

6.3 Moderation

The publisher reserves the right to refuse, modify, suspend or remove, without notice and without compensation, any listing or advertisement contrary to these Terms, the law, or the Site's editorial line. If a professional account is deleted, the publisher may retain certain data for legal purposes (in particular accounting and billing), in accordance with the Privacy Policy.

6.4 Reporting

Any manifestly unlawful content may be reported to the publisher at hello@agde.city. The publisher undertakes to act promptly to remove such content once it has actual knowledge of it.

7. Hyperlinks

The Site may contain links to third-party sites. The publisher has no control over these sites and declines all responsibility for their content, availability or data protection practices.

8. Publisher's liability

The publisher provides the Site "as is" and cannot be held liable for:

direct or indirect damage resulting from access to or use of the Site;
temporary or permanent unavailability of the Site;
errors, inaccuracies or omissions in the information published;
the presence of viruses or other harmful elements, despite the security measures implemented.

9. Personal data

The processing of personal data is described in the Privacy Policy, in compliance with the GDPR.

10. Amendment of the Terms

The publisher reserves the right to amend these Terms at any time. The applicable version is the one in force at the time of accessing the Site. Users are invited to consult them regularly. The last update date appears at the top of the document.

11. Applicable law and disputes

These Terms are governed by French law. In the event of a dispute, the User may use conventional mediation or any other alternative dispute resolution method. Failing amicable resolution, the French courts shall have sole jurisdiction.
